'킬링필드' 30주년 - 캄보디아, 역사의 재판이 필요해 <영문기사 첨부>


캄보디아의 크메르 루주는 30년전 이달 집권했었습니다. 지난 1978년 12월 전복되기 전까지 크메르 루주는 대략 150만명 내지 300만명의 캄보디아인을 학살했습니다.

공산주의자의 전체주의적인 이념노선에 따라, 크메르 루주 정권은 캄보디아의 대도시 주민들을 식량도, 농기기도, 의료시설도 없는 농촌으로 강제로 이주시켜, 대도시들을 텅 비게 만들었습니다. 이 과정에서 수만명이 굶어죽거나 각종 질병으로 죽었습니다. 명령에 반항하거나 따지는 사람들은 가차없이 살해됐습니다. 크메르 루주는 캄보디아의 지식인, 의사, 교사등 전문인들과 함께 과거 정권의 군과 민간 지도자들을 조직적으로 학살했습니다.

이 같은 잔학행위를 자행한 자들은 아직도 처벌을 받지 않고 있습니다. 지난 4월 21일, 미 국무부는 다음과 같은 성명을 발표했습니다.

“미국은 이 같은 잔학행위에 대한 책임 규명이 있어야 한다고 믿고 있으며, 크메르 루주 재판소를 설치하기 위한 유엔과 캄보디아간의 협정을 환영하는 바입니다. 미국법이 규정하는 바에 따라 미국이 이같은 과정에 기여하기위해선, 이 재판소가 국제적으로 공인되는 사법 기준을 충족시켜야 한다고 믿습니다. 앞으로 이 재판소가 설치되는 과정에서 미국은 이 같은 목표를 달성하기 위해 캄보디아정부와 유엔과 이해당사국들과 협력해 나갈 것입니다.”

캄보디아에 본부를 둔 인권단체 [캄보디아 보호자계획]의 속 삼 큰 전무이사는 관련자들을 재판하지 않을 경우, 1979년 이후에 태어난 캄보디아 인들은 과거를 완전히 망각하게 될지도 모른다고 말합니다.

“크메르 루주 시절의 상황이 얼마나 참혹했는지에 대해서는 아무도 상상할 수가 없습니다. 주지하다시피, 그것은 인간의 짓이 아니었습니다. 이성이 있는 사람들이라면 그런 끔찍한 만행을 생각할 수가 없습니다. 이것이 바로 요즘 젊은이들이 쉽게 믿지 못하는 이유입니다. 아마도 젊은이들은 이들의 부모들이 정보를 왜곡하는 것이라고 생각합니다.”

프놈펜의 한 옛 교도소는 박물관으로 개조되어 과거의 크메르 루주의 잔학상을 생생하게 보여주며, 캄보디아 인들과 외국인들에게 캄보디아 역사의 끔찍했던 시절에 관해 교육을 실시하고 있습니다.

캄보디아는 여전히 빈곤과, 법치의 결여, 부패 등 많은 도전에 직면해 있습니다.

아담 에럴리 미 국무부 부대변인은 미국은 캄보디아에서 독립적인 사법체제의 필요성을 계속 집중 부각시켜 나갈 것이라고 말합니다. 형벌을 면할 수 없도록 방벽을 쌓고 크메르 루주와 같은 정권이 역사의 슬픈 기록에서만 존재할 수 있게 하는 것은 오로지 법치의 존중과 효율적인 민주제도를 통해서만 가능한 것입니다.

April marks the 30th anniversary of the seizure of power by the Khmer Rouge in Cambodia. Before being
overthrown in December 1978, the Khmer Rouge would be responsible for the deaths of an estimated one-and-a-half
million to three-million Cambodians.

In line with its Communist totalitarian ideology, the Khmer Rouge regime emptied Cambodia's major cities, forcing
residents into the countryside where they lacked food, agricultural implements, and medical care. Tens of thousands
starved to death or died of disease. Those who resisted or questioned orders were killed. The Khmer Rouge
systematically murdered military and civilian leaders of the former government, as well as Cambodian intellectuals,
doctors, teachers, and other professionals.

Those responsible for these atrocities have still not been held accountable. On April 21, the U.S. State Department
issued a statement that said:

"The United States believes there must be accountability for these atrocities, and welcomed the agreement
between the United Nations and Cambodia to establish the Khmer Rouge Tribunal. For the United States to
contribute to this process, we believe, as the U.S. law stipulates, that the tribunal must meet internationally
recognized standards of justice. As the formation of the tribunal moves forward, we will engage with the government
of Cambodia, the United Nations, and interested countries to achieve this goal."

Sok Sam Oeun is executive director of the Cambodian Defenders Project, a human rights group based in
Cambodia. Mr. Sok says without a tribunal, Cambodians born after 1979 may forget the past:

"No one can imagine how serious [the situation was] during the
Khmer Rouge. It's not human you know. Reasonable people do not think that something like that happened. That's
why it is very hard to make those young people believe. Maybe they think their parents maybe distort information
like that."

In Phnom Penh, a former prison has been converted into a museum to document Khmer Rouge atrocities and
educate Cambodians and foreigners about this terrible period of Cambodia's history. Cambodia still faces many
challenges, including poverty, lack of a rule of law, and corruption. U.S. State Department deputy spokesman Adam
Ereli says that the United States will continue to focus on the need for an independent judiciary in Cambodia. It is
only through respect for the rule of law and the existence of effective democratic institutions that barriers to
impunity will be built and regimes like that of the Khmer Rouge will exist only in the sad annals of history.
