미국 연방 대법원이 오늘 10월 2일, 새로운 회기를 시작합니다. 이번 회기 동안 대법원은 낙태 권리와 인종에 기반을 둔 학교 입학을 비롯한 여러 소송 사건들에 대한 중요한 판결을 내릴 예정입니다.

역사적으로 볼 때, 그처럼 커다란 논란을 불러 일으키는 어려운 현안들은 9명의 대법원 판사들에게 결코 새로운 것이 아닙니다. 국가정책수립과 수행과정에 있어서의 미국대법원의 역할을 진단하는 심층보도입니다.

미국 연방 대법원의 업무는 단순히 표현하면, 대법원에 소송이 제기된 법률 사건 본안에 대해 결정을 내릴 때, 헌법에 명시된 법률적 토대를 적용하는 것입니다.

워싱턴 디씨 소재 [아메리칸 대학교]의 스티븐 워밀 법학교수는 1787년에 제정된 미국 헌법은 대법원의 역할과 대법원 권한의 근원, 혹은 대법원 판결의 지침 같은 것들에

관해 구체적인 정보를 거의 제공하지 않기 때문에, 대법원의 그같은 업무는 대단히 어려운 일이라고 지적합니다.

대법원이 의회나 대통령의 행동에 대해 위헌이라고 선언할 권한이 있다고 미국 헌법에 구체적으로 명시돼 있는 것은 아니라고, 워밀 교수는 설명했습니다.

19세기 초, 대법원은 마침내, 대법원이 입법부와 행정부 등 삼권분립을 이루는 다른 대등한 2개 정부 내 헌법 기관들의 결정을 번복할 수 있는 권한을 갖고 있다고 주장했습니다.

대법원은 스스로에게 이른바 [위헌 심사(Judicial Review)] 권한을 부여했다고, 워밀 교수는 말합니다.

대법원은 지금부터 200여 년 전부터 그같은 역할을 주장했으며, 이제는 대법원이 의회의 행동을 무효화하거나

대통령의 행동을 봉쇄할 수 있다는 사실이 아주 잘 정착돼 있다고, 워밀 교수는 지적했습니다.

워밀 교수는 대법원은 혼란기였던 1950년대 부터 위헌 심사 권한을 사용하는데 있어 확대된 역할을 맡았다고 말합니다.

워밀 교수는 그 당시 대법원은 먼저, 미국 대부분 지역의 공립학교에서 법률로 규정돼 있던, 인종차별이나 다름없는 인종간 즉 흑백 학생 분리를 철폐하라고 명령했다면서, 상당한 논란을 불러 일으킨 판결이었지만, 현대 대법원을 특징짓는 중요한 판결이었다고 설명했습니다. 워밀 교수는 대법원은 또한 공립 학교 교실에서 기도문을 암송하던 오랜 관행을 중단하도록 명령하면서, 학생들에게 공개적으로 기도를 하도록 강요하는 것은 교회와 국가의 분리 원칙을 위반하는 것이라고 지적했다고 말했습니다. 대단히 중요한 결정이었지만, 또한 비판도 많이 받았다고, 워밀 교수는 덧붙였습니다.

워밀 교수는 헌법이 원래의 문구나 의미에 제한돼야 한다고 주장하는 사람들은 대법원이 헌법에 내재된 권리의 존재를 읽어낼 수 있어야 한다고는 생각하지 않는다고 말하면서,

그러나 또 다른 한편에서는, 대법원이 각 시대와 시기의 현안에 적용할 수 있도록 헌법을 해석할 수 있는 능력을 갖고 있어야 하며, 그렇지 않을 경우 헌법은 의미없고 쓸모없는 문서에 지나지 않을 것이라고 생각하는 사람들도 있다고 덧붙였습니다.

워밀 교수는 지난 몇 십년 동안, 그리고 현재의 대법원 또한, 한 명이나 두 명의 대법관이 대법원의 교착상태를 깨는 이른바 스윙 보트의 역할을 하는 일이 많았다고 지적합니다.

워밀 교수는 지난 30년 동안 대법원에서 스윙 보트로 알려진 중도적 성향의 대법관이 중요한 역할을 맡아 온 것이 분명하다고 생각한다면서, 그같은 역할을 맡은 첫번째 대법관은 1972년부터 1998년까지 대법관을 역임한 루이스 파월 판사였고, 그 뒤를 1981년부터 지난 회기까지 대법관을 지낸 역임한 샌드라 데이 오코너 대법관이 이었다고 말했습니다. 워밀 교수는 이제 오코너 대법관이 은퇴했기 때문에, 모든 사람들이 앤쏘니 케네디 대법관을 주목하고 있다면서, 대법원에서 4대4로 의견이 갈리는 많은 현안들에서, 케네디 대법관의 결정에 따라 그 결과가 달라질 것이라고 덧붙였습니다.

워밀 교수는 그같은 논란은 해결책이 없는 것이라면서, 대법관들마다 견해가 다르기 때문에 영원히 해결되기 힘들 것이라고 덧붙였습니다.

임기가 2년 정도 남은 부시 대통령이 헌법의 엄격한 해석을 선호하는 대법관을 한 명 더 임명함으로써 대법원이 역사적으로 새로운 길로 접을 들 수 있도록 만들 수 있는 기회를 갖지 않는 한, 그같은 논란은 해소되기가 어렵다고, 다른 법률 전문가들도 지적했습니다.

INTRO: The United States Supreme Court, which opens its new term today/Monday/October 2nd, is scheduled to issue key rulings on cases involving abortion rights and race-based school enrollment. As VOA's Andrew Baroch reports, difficult and controversial issues are hardly new to the nine justices of the High Court.

TEXT: The job of the U-S Supreme Court is, simply put, to apply the legal foundations set out in the Constitution of the United States in deciding the merits of legal cases brought before the court.

Steven Wermiel [WUR-meal], a professor of law at the American University in Washington, D.C., says that it's a difficult job because the Constitution, written in 1787, offers very little specific information about the role of the High Court, the source of its authority, or guidelines for its rulings.

DALET CUT ONE - WERMIEL
"The U-S Constitution doesn't specifically say that it has the power to declare unconstitutional acts of the legislature or acts of the president."

TEXT: In the early 19th century, the High Court finally asserted its authority to over-rule decisions of the other two co-equal branches of government: the Congress and the Presidency. The High Court, Professor Wermiel says, gave itself the power of so-called judicial review.

DALET CUT TWO -- WERMIEL
"The court has asserted that role for more than 200 years now, and it's pretty well established that the Supreme Court can strike down acts of Congress or block acts of the President."

TEXT: Wermiel says the High Court assumed "an expansive role" in the use of judicial review starting in the turbulent 1950's.

DALET CUT THREE - WERMIEL
"During that period, the court ordered desegregation -- first of the public schools throughout the United States, which as in many part of the country, had been racially separated by law, not unlike apartheid. This was quite controversial, but a major hallmark of the modern court. The modern court also ordered a halt to the longstanding practice of reciting religious prayers in public school classrooms. The court said this kind of mandatory, publicly-imposed prayer violated the principle of 'separation of church and state.' That was a very important but also widely criticized decision."

TEXT: Wermiel notes that the ruling on school prayer was particularly controversial because the words, "the separation of church and state," are not found in the Constitution. Rather, the court interpreted what its justices believed was the intent of the Framers of the Constitution to separate religious and government institutions.

Similarly, in a 1973 landmark ruling legalizing abortion in the United States, the High Court ruled that women have a constitutional right to privacy in deciding whether to terminate their own pregnancies. Another controversial ruling, says Wermiel, because there's no mention in the Constitution about a citizen's right to privacy.

"Those who argue that the Constitution ought to be limited to its original language or meaning don't think the Court ought to be able to read the existence of an implicit right into the Constitution. [On the other hand], ]you have people who believe the Court must be able to read the Constitution in a way that is adapted to the issues of each era and each time -- otherwise the Constitution would be a meaningless and obsolete document."

TEXT: Professor Wermiel says that in recent decades -- and with the current court, as well -- one or two justices frequently play the role of the so-called swing vote -- a justice who breaks a high-court stalemate.

There clearly is, I think, in the last 30 years, a dominant influence in the Supreme Court of what has come to be known as the 'swing vote' -- a justice in the middle, who sometimes sees a narrow role for the court and sometimes a broader role. The first justice to play that role was Justice Lewis Powell, who served from 1972 to 198. He was succeeded in that role by Justice Sandra Day O'Connor. She served from 1981 until last term. Now that she has retired, all eyes are on Justice Anthony Kennedy - that he may be seen as the right smack-in-the-middle defining vote of the [nine-member] court in many issues where the court is split four to four -- that it will be his vote that may determine the outcome."


TEXT: The Supreme Court is scheduled to hear 31 cases this term. Notable among them -- whether partial-birth abortion -- a rare but controversial procedure which has been banned by Congress, should be made legal. The court will also decide on the legitimacy of so-called affirmative-action policies - whether public, government-funded elementary and high schools should be required to maintain a racially-diverse student population.

Again, says Professor Wermiel, the debate comes down to whether the High Court should interpret the Constitution or stick to the strict language of the document.

"It really is not a debate that can be resolved. There are justices on the court who hold both of those views: some, one view, some the other. I don't think we'll ever really settle that."
