터키 헌법재판소의 하심 킬리치 재판소장은 정의개발당, AKP 해체 소송에 대한 판결결과를 기자들에게 발표하면서 헌법상 정당 해체는 헌법재판관 11명 가운데 일곱 명 이상이 찬성해야 이루어지는데 이번 심리가 그에 미치지 못했다고 설명했습니다.
킬리치 재판소장은 AKP 해체에 찬성한 재판관은 여섯 명이고 네 명의 재판관은 벌금부과를 찬성했다고 밝히고 그에 따라 AKP 해체 불가판결이 내려진 것이라고 말했습니다.
터키 헌법재판소는 터키를 회교통치 국가로 이끌어 가려는 정의개발당, AKP에 대한 해체 소송을 사흘 동안 심리한 끝에 해체불가 판결을 내린 것입니다.
터키 헌법재판소는 또 레젭 타입 에르도안 총리와 압둘라 굴 대통령을 비롯한 집권당 소속 의원 일흔 한 명에 대한 제적도 불가판결을 내렸습니다.
터키 헌법재판소는 AKP가 세속정부 보장에 관한 헌법을 위반했다고 인정했는데도 불구하고 에르도안 총리는 이 판결이 정의개발당의 승리라고 주장했습니다.
에르도안 총리는 헌법재판소의 판결로 AKP가 살아났을 뿐만 아니라 터키가 살아난 것이라고 강조하면서 AKP는 민주적이고 세속적인 방향으로 나라를 계속해서 이끌어나갈 것이라고 다짐했습니다.

킬리치 재판소장은 판결문 내용을 설명하면서 AKP가 판결내용을 아주 신중하게 분석평가하고 판결문에 담겨 있는 메시지를 파악하기를 바란다고 말했습니다. 킬리치 재판소장은 AKP가 비록 해체를 모면했지만 헌법재판소의 이번 판결은 실제로 AKP에 대한 엄중한 경고임을 분명히 밝혔습니다. 또 킬리치 재판소장이 AKP 해체에 반대했다는 점에서 이와 같은 경고에 더 큰 무게가 실려있습니다. 킬리치 재판소장은 검찰당국은 앞으로 정당해체 소송을 새로 제기할 수 있다면서 헌법재판소도 그에 대한 심리를 다시 할 것임을 명확히 밝혔습니다.

Turkey's constitutional court Wednesday ruled against banning the governing
Justice and Development Party, or AK party, and instead opted to fine it after
finding it guilty of undermining the secular state. Dorian Jones reports from
Istanbul the ruling is seen as a last warning to the party.
The head
of Turkey's constitutional court, Judge Hasim Kilic, said the justices decided
to cut half of the treasury funds to which the AK party was entitled. He said
six judges voted in favor of closure and four supported fining the party.
Under Turkey's constitution, seven of the court's 11 judges are
required to agree on a motion to close a politcal party .
The verdict
came after three days of deliberations on whether the party had been seeking to
steer Turkey toward Islamic rule.
The court's ruling also ended the
threat of expulsion for 71 senior members of the ruling party, including prime
minister Recep Tayyip Erdogan and president Abdullah Gul.
Despite being
found guilty by the court of undermining the secular state, Erdogan saw the
verdict as a victory. He said the ruling saved not only the AK party but Turkey
itself. He said his party will continue its road to a democratic and secular
Turkey.
The verdict is also seen as a relief to the European Union,
which Turkey is seeking to join. EU officials welcomed the decision, describing
it as a positive step for democracy. But that euphoria may be tempered by the
warning Kilic made while explaining his verdict.
He said he hopes the
party will evaluate this outcome very carefuly and get the message it should
get. He said even though the party was not closed, the ruling is a very serious
warning.
Kilic's warning carries even more weight because he was one of
the judges who opposed the closure of the party. He also said the state
prosecutor was free to file a new closure case in the future, saying the court
would consider it.
The leader of the opposition Republican People's
Party (CHP), Deniz Baykal said the crisis over the AK party continues.
He
said the verdict has put the government back in control of its own fate.
