식지않는 美 의회의 열띤공방, 이해관계 얽힌 의제들로 연말에도 첨예한 대립 (영문기사 첨부)


미국 연방의회의 금년도 회기말이 임박한 가운데 의원들은 몇 가지 중요한 의제들을 처리하기 위해 협상을 벌이고 있습니다.

미 의회의 막바지 주요 의제들 가운데 가장 큰 논란이 되고 있는 의제는 미국이 구금하고 있는 테러 용의자들에 대한 처우 문제입니다.

이 시간에는 미 의회의 회기말 주요의제들과 테러 혐의 구금자들에 대한 처우문제를 둘러싼 공방의 내용을 알아봅니다.

미국 연방의회는 보통12월 이맘때쯤이면 10여개 정도의 주로 행정부의 집행예산안들을 포함한 의제들의 막바지 협상을 마무리한뒤 상원과 하원, 모두 휴회에 들어갑니다.

그러나 올해엔, 공화당과 민주당 의원들 모두에게 커다란 정치적 이해관계가 걸려있는 일곱 개의 의제들을 놓고 첨예한 공방을 벌이느라 여느때 보다 훨씬 힘겨운 회기말을 보내고 있습니다.

공화당 의원들은 연방정부 재정적자 감소법안과 세금감축 확대안을 이번 회기안에 처리해서 죠지 부쉬 대통령에게 보내려 하고 있습니다. 그런데 하원과 상원에서 통과된 행정부 예산법안은 서로간에 금액에 있어서 150억 달러에 이르는 큰 차이가 있습니다.

행정부의 집행 예산안은 내년 중간선거를 앞두고 있는 예산문제에 관한한 보수적인 공화당 소속 의원들에겐 중대한 사안입니다. 이들은 정부의 예산집행을 절제해야 한다고 공공연히 주장하고 있습니다.

정부예산안과 감세법안에는 고도로 민감한 다른 법안들이 첨부돼 있습니다. 다른 민감한 법안들이란 민주당 의원들에게는 물론 공화당 중도파 의원들에 다같이 민감한 주요 사회복지 예산 삭감에 관한 것입니다.

또한 정치적으로 오랫동안 뜨거운 감자로 떠올라 있는 알라스카주 국립공원 지역내 석유채굴 허가 문제를 놓고도 격론이 벌어지고 있습니다.

그러나 가장 뜨거운 공방이 벌어지고 있는 분야는 국방예산안입니다. 이 법안에는 공화당의 죤 맥케인 의원이 제출한 테러용의자 가혹행위금지 법안이 첨부돼 있는 가운데 상원과 하원 그리고 행정부가 협상을 벌이고 있습니다.

맥케인 의원은 자신이 제출한 법안의 어떠한 수정도 받아들이지 않을 것이라고 강경한 입장을 취하는 가운데 백악관측과 대화를 하고 있습니다.

공화당 소속의 린지 그램 상원의원은 지난 일요일 NBC 텔레비전 방송의 밋 더 프레스 프로그램에서 테러용의자 심문 방침의 표준화에 관한 타협의 실패는 미국의 테러리즘 전쟁수행 능력에 타격이 될 것이라고 지적했습니다.

“ 우리의 테러용의자 심문방침과 심문정책의 해석은 혼선과 오해를 빚고 있습니다. 우리의 군은 어떤 것은 해도 되고 어떤 것은 해선 안되는 것인지를 모르기 때문에 곤경을 겪고 있습니다. 그래서 맥케인 의원의 법안은 모든 것들을 하나로 묶어서 할 수 있는 것과 할 수 없는 것을 알수 있도록 하자는 것입니다. ”

일부 비판자들은 린지 그램 의원이 내놓은 수정안은 테러용의자들이 미국 법원에 인신보호 영장을 청구할 수 있는 권리를 축소시킨다고 반대하고 있습니다.

부쉬 대통령은 최근 미국이 테러용의 구금자들을 고문하지 않는다고 말했고 콘돌리사 라이스 국무장관은 고문 문제에 관한 미국의 원칙을 분명히 밝혔습니다.

한편, 테러용의 구금자 처우와 그들의 법적 보호 문제에 관해 12일 열린 브루킹스 연구소의 토론회에서 백악관의 법률고문이었던 브래드 베렌슨씨는 부쉬 대통령 행정부의 테러리즘 전쟁에 관한 입장을 지지했습니다. 9-11 테러 공격후 테러리즘에 대한 전쟁은 테러용의자 구금에 관한 새로운 법적 기본틀을 필요로 하고 있다는 것입니다.

“ 테러리즘과의 전쟁은 이전에 그런 전쟁이 없었던 상황에 우리가 익숙해 있던 때와는 전혀 다른 법적 틀의 필요성을 불러일으켰습니다. 테러리즘과의 전쟁에서는 테러를 자행하는 용의자들을 적으로 하는 경우에 아무런 절차도, 사전 경고도, 그 무엇도 없이 그런 자들을 제거해야 할 권리가 있다는 점에서 그 것은 명백해 집니다. 그렇게 하는 것은 우리의 의무입니다. ”

그러나 관타나모 미 해군기지 수용소에 구금돼 있는 테러 용의자들을 대변하는 톰 윌너 변호인은 그러한 구금정책이 미국의 이익을 해치고 있다고 주장합니다.…”

“ 전쟁에 있어서 법정예심이나 인간적인 대우 같은 기본적인 최소한의 법을 따르지 않겠다는 결정은 관타나모 수용소와 아부 그라이브 수용소를 미국의 테러리즘에 대한 전쟁과 동격으로 만드는 결과를 초래했습니다. 아부 그라이브와 관타나모 수용소는 테러리즘과의 전쟁에 있어서 미국이 이용할 최악의 인상이라고 생각합니다.”

회기말을 앞둔 미국 의회의 또 다른 골칫거리로 떠오를 가능성이 있는 것은 이른바 애국법에 추가되는 16개 조항입니다.

부쉬 대통령에게 가장 우선적인 상.하 양원 조정안이 하원에서는 통과될 가능성이 있으나 상원에서는 민주당 의원들의 의사진행 지연술 발동과 일부 중도적인 공화당 의원들의 반대에 직면할 수도 있습니다.

그 밖에 국경보안과 이민 관계법이 또 다른 쟁점으로 불거질 것으로 예상되는 가운데 부쉬 대통령은 이 의제만은 내년 회기로 넘겨지기를 기대하고 있는 것으로 보입니다.

INTRO: Congressional lawmakers face several days of hard work and tough negotiations as they try to enact key legislation before the end of the year. VOA's Dan Robinson reports from Capitol Hill, one major issue involves the question of treatment of terrorist suspects detained in the war on terrorism:

TEXT: Normally by this point in December, the House and the Senate have adjourned after dealing with last-minute legislation, in particular the dozen or so spending bills required to keep government programs going.

This year, however, lawmakers have some big legislative hurdles to overcome, contained in seven priority bills, with high political stakes for Republicans and Democrats.

On two closely-linked domestic issues, Republicans in control of Congress hope to be able to send bills to reduce the federal budget, and extend tax cuts to President Bush's desk.

Budget legislation, on which House and Senate-passed bills differ by about 15-billion dollars, has implications for Republican budget conservatives ahead of next year's mid-term congressional elections, who have been outspoken on restraining government spending.

Attached to tax and budget bills are other highly-sensitive issues, including concerns of Democrats and moderate Republicans about cutting funding for key social programs, and the long-running red hot political debate over allowing oil exploration in Alaska's National Wildlife Refuge.

Some of the sharpest debate is expected as lawmakers seek to overcome differences blocking passage of bills authorizing and appropriating billions of dollars for defense.

Negotiations have taken place involving House and Senate lawmakers and the White House over a provision by Republican Senator John McCain to prohibit "cruel, inhumane or degrading" treatment of detainees by anyone in the U.S. military or government.

Senator McCain has insisted he would not accept changes, but has been talking with the White House.

Appearing [Sunday] on NBC's Meet the Press, Republican Senator Lindsey Graham said failure to reach a compromise on standardizing interrogation policies would damage the U.S. ability to carry out the war on terrorism:

"Our interrogation policy, interpretations of interrogation policy, has been confusing, misleading, and our own troops have suffered because they don't know what is in bounds and what is not. So, the McCain language attempts to put it all in one spot so they will understand what they can and can't do."

President Bush stated recently that the United States does not torture detainees, and Secretary of State Condoleezza Rice issued clarifications about U.S. principles on the issue.

/// OPT /// Debate over treatment of detainees and legal protections continued at a panel discussion [Monday] at Washington's Brookings Institution.

There, a former White House Associate Counsel Brad Berenson supported the Bush administration's position that the war on terrorism created the need for a new legal framework regarding detainees. Attorney Tom Wilner, who represented detainees at Guantanamo Bay, Cuba, said detainee policies had damaged U.S. interests:

BERENSON: "War calls forth an entirely different legal framework than we are accustomed to in situations that do not involve war. To make it obvious, when you are at war and you have a suspected adversary across from you are entitled to kill that person with no due process or advance warning whatsoever, indeed it is your obligation to do that."

WILNER: "The results of this decision to not abide by the basic minimal laws of war, a hearing and humane treatment, are that Guantanamo and Abu Ghraib have become synonymous with the U.S. war on terror. And those are about the worst possible images that we could use for the war on terror. Those are the best possible images that al-Qaida could have ever come up with to assign to the United States in the war on terror.

There is also potential trouble on the horizon on another key piece of legislation, renewal of 16 provisions of the anti-terrorism law known as the Patriot Act.

A main agenda priority for President Bush, a House-Senate compromise agreement on the bill comes up for a vote in the House, but faces a possible filibuster by Senate Democrats, and opposition from some Senate Republicans.

Meanwhile, the House is also preparing for what is expected to be an emotional debate and vote on a border security and immigration bill, setting the stage for what President Bush hopes will be action by the full Congress next year on another of his priorities, immigration reform. (signed)
